Review Changes to the Land Use Code

City staff have been working to update portions of the Land Use Code related to commercial corridors and centers. The draft has been posted and is open for public review. Using the link below, scroll down to see each article and a summary of the proposed changes for each. At the bottom of the page, there is a form where the public can submit their questions or comments.

Conceptual Design Reviews

Conceptual Design Reviews (CDRs) are like a free consultation for anyone considering applying for Development Review. The applicant can get initial staff feedback on their idea before investing in a formal application. they must occur before a neighborhood meeting can be scheduled or an application can be submitted for Development Review

There are three (3) conceptual design reviews this week on THURSDAY

Triplex at 629 Stover Street, CDR250058 - 9:15 a.m.

This is a request to develop a triplex at 629 Stover St. The applicant is request to make the existing structure a legal triplex. Access can be taken from Stover St. The property is located approximately 0.17 mi south of E Mulberry St and approximately 0.39 mi west of Riverside Ave. The site is located in the Old Town, Medium (OT-B) zone district and is subject to a Planning and Zoning (Type 2) Review.

Single Unit Home at 5416 CR 7, CDR250059 - 10:15 a.m.

This is a request to build a single unit dwelling at 5416 CR 7 #B. The applicant is requesting to build a home on a new lot. Access can be taken from S County Rd 7 to the west. The property is directly east of Strauss Cabin Rd and approximately 0.11 mi north of Kecther Rd. The site is located in the Urban Estate (UE) zone district and is subject to an Administrative (Type 1) Review.

Expansion at 1000 Whedbee Street, CDR250060 - 11:15 a.m.

This is a request to continue an auto repair shop and add commercial retail use at 500 Garfield St/1000 Whedbee St. The proposal would continue the operation of the service station, with improvements to expand the customer waiting area, adding a kitchen, counter, display cases, and customer seating and tables. Access to the property is taken from Whedbee St to the west and Garfield St south of the property. The site is approximately 0.53 miles south of E Mulberry St. and 0.37 miles east of S College Ave. The site is within the Old Town, Medium (OT-B) zone district and the project would be subject to Addition of Permitted Use (APU) Review.

Preliminary Design Reviews

Preliminary Design Reviews (PDRs) serve as initial conversations between an applicant and City staff to determine whether a proposal aligns with the Land Use Code and prepare for a Development Review process. PDRs are for more complex proposals and the applicant pays a fee for them, unlike CDRs. Like CDRs, they occur before any neighborhood meetings and applications for Development Review.

Neighborhood Meetings

Neighborhood Meetings are required for some proposals between their PDR or CDR and when they submit an application for Development Review. They are an opportunity for the public to learn about the proposal, ask questions about the proposal and make comments which will be provided to the decision makers at the end of Development Review. City staff, led by the Planning Department, review development proposals to make sure they follow the City's Land Use Code and other standards. To view all development proposals currently in review by the City, visit https://www.fcgov.com/developmentreview/proposals#under-review. You can search for a specific proposal by type, status or sign number, or use the search box to find proposals by name, street name/address, or of the information provided on each proposal, including:

  • Project name
  • Project number (including a link to the proposal's workflow tracking page)

  • Public Records (including a link to all documents in the submittal)

Please note: Only submitted proposals will appear in this table. Projects which are scheduled for a Preliminary Design Review, Conceptual Review or Neighborhood Meeting have not been submitted to the City yet and will be listed on the same webpage but in their own tables.

Administrative (Type 1) Hearings

Type 1 Administrative Hearings are the final decision making step for proposals which can be approved by a hearing officer. Hearing officers are individuals which are not City staff but have knowledge of the City's Land Use Code. They will see the proposal, hear staff analysis and consider public feedback in a formal hearing, then issue a decision within 10 days.

To Participate: Administrative hearings are being conducted remotely.  You can participate over the phone, on the internet, or through the Zoom app on a smartphone, tablet, or computer.  Virtual participation information and information about the project being heard are both available at https://www.fcgov.com/developmentreview/proposals at least 48 hours before the hearing.

Planning And Zoning Commission (Type 2) Hearings

Planning and Zoning Commission (P&Z) hearings are the final decision step for development proposals which require approval by a quasi-judicial commission. P&Z is a group of volunteer residents appointed by City Council who review land use proposals to make sure they follow the rules in our Land Use Code. They also make recommendations to the City Council regarding zoning, annexations, major public and private projects and any long range planning activities (such as City Plan or subarea plans). For Planning and Development Review, part of their role is to approve rezonings, annexations and additions of permitted use requests as well as hearing appeals to the decisions made by the Planning and Zoning Commission or a hearing officer. Historic Preservation Services

HISTORIC PRESERVATION COMMISSION

The Historic Preservation Commission (HPC) is tasked with the local landmark designation of historic properties and the review and approval of plans for exterior changes to them.

HISTORIC DEMOLITION NOTICES AND SURVEYS

Notices of Demolition are intended to notify neighbors of a change near them, as well as allow residents the opportunity to nominate the property for landmark designation. To learn more about how to submit a petition to nominate a property scheduled for demolition as a landmark, visit https://www.fcgov.com/historicpreservation/demolition-review 

Historic Surveys indicate when a property is being considered for landmark designation. If you have information about the history of any of these properties that could be incorporated into the survey, or if you would like a copy of any completed survey, please contact preservation@fcgov.com. After a determination of Landmark eligibility is made through the finalization of the survey, any Fort Collins resident or property owner may file an appeal within 14 days to challenge the determination and schedule a public hearing with the HPC. 

Current Notices of Demolition

The City of Fort Collins requires notification prior to demolition of single-unit dwellings over 50 years of age.  If three or more residents of the city believe that any properties are eligible for City Landmark designation, they may choose to submit an application for designation preservation@fcgov.com

Current Historic Surveys

The following properties are currently being researched to determine if they are Eligible as Fort Collins Landmarks. Members of the public with information regarding the history of these properties should contact Historic Preservation Services at preservation@fcgov.com. Official historic survey results may be appealed by the developer, property owner, or any member of the public within 14 (fourteen) days of issuance.

  • 5630 Tilden St, single-family dwelling, built 1974 - potential City affordable housing project
  • 4305 & 4325 E Harmony Rd, built in 1920 and 1971 - demolition for new development proposed
  • 237-241 Linden St, built in 1964 - facade modifications proposed

Completed

  • 622 S. Grant Ave, duplex built 1940 - Not Eligible - Issued Sept. 5

Land Use Review Commission

The Land Use Review Commission is made up of volunteer residents who can approve variances from the requirements of the Land Use Code and hear appeals from any decision made by an administrative official pertaining to a specific property.

September Meeting Agenda

Appeal ZBA250023, 1213 Ticonderoga Dr -This is a request for a proposed 6-foot-tall fence to be built between the front building line and the front property line. The proposed section of fencing is 16.5 feet total in length. The maximum height for a fence between the front building and the front property line is 4 feet 

Appeal ZBA250025, 35 S Taft Hill Rd - There are two requests associated with this variance application:
1. A request for a proposed 792 square-foot detached accessory building (2 car garage) to be built 2 feet 6 inches from the rear property line. The minimum required rear setback in the LMN zone district is 8 feet. The request is to therefore encroach 5 feet 6 inches into the required rear setback.
2. A request for an eave of the proposed detached accessory structure to be placed 0 feet from the rear property line. The minimum required rear setback in the LMN zone district is 8 feet, into which an eave can encroach up to 2 feet 6 inches. The request is to therefore allow the eave to encroach an additional 5 feet 6 inches to the required setback

Appeal ZBA250026, 806 Peterson St - This is a request for an 84 square-foot proposed front porch to be constructed 13 feet from the front property line. The minimum required front setback in the OT-B Zone District is 15 feet. The request is therefore to encroach 2 feet into the required front setback.

Appeal ZBA250027, 307 S Loomis Ave - This is a request for a proposed 868 square-foot detached accessory building (garage with habitable space above). The maximum allowable floor area for a detached accessory structure in the OT-A Zone District is 600 square feet. Their request is to therefore exceed the maximum allowable floor area for a detached accessory structure by 268 square feet.
